1. Acceptance of Terms
By accessing, browsing, or using Crovia ("the Platform", "the Service"), operated from Finland, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions ("Terms"). If you do not agree, you must immediately cease using the Platform. These Terms constitute a legally binding agreement between you ("User", "you") and the operator of Crovia ("we", "us", "the Operator").
2. Description of Service
Crovia is an NFT marketplace aggregator operating on the Cronos blockchain. The Platform indexes and displays NFTs from multiple third-party marketplaces including, but not limited to, Ebisusbay, Minted Network, and Crypto.com/NFT, as well as the Crovia marketplace. Crovia facilitates browsing, analytics, and trading of NFTs.
Crovia is an information aggregation and transaction facilitation tool only. We do not create, mint, endorse, or guarantee any NFT or digital asset displayed on the Platform. We are not a party to any transaction between users unless explicitly stated.
3. Eligibility
You must be at least 18 years of age (or the age of legal majority in your jurisdiction) to use the Platform. By using the Platform, you represent and warrant that you meet this requirement and have the legal capacity to enter into these Terms. If you are using the Platform on behalf of an entity, you represent that you have authority to bind that entity to these Terms.
4. No Financial, Investment, or Legal Advice
Nothing on this Platform constitutes financial, investment, legal, or tax advice. NFTs and cryptocurrencies are highly speculative digital assets with significant risk of loss. You should conduct your own research and consult independent professional advisors before making any purchasing or trading decisions. Past performance, floor prices, volume data, and analytics displayed on the Platform do not guarantee future results. We make no representations regarding the future value of any digital asset.
5. Wallet Security & User Responsibility
You are solely and exclusively responsible for the security of your cryptocurrency wallet, private keys, seed phrases, and any credentials associated with your blockchain accounts.
The Operator does not have access to, custody of, or control over your wallet, private keys, or digital assets at any time. Crovia never requests your private keys or seed phrases. The Platform interacts with your wallet solely through standard Web3 wallet connection protocols (e.g., MetaMask) where you explicitly approve each transaction.
In the event that your wallet is compromised, hacked, drained, or otherwise accessed by unauthorized third parties, the Operator bears absolutely no responsibility or liability. This includes, but is not limited to:
- Phishing attacks, malicious smart contract approvals, or social engineering
- Malware, keyloggers, or compromised devices
- Leaked or stolen private keys or seed phrases
- Exploits in third-party smart contracts, wallets, or browser extensions
- Unauthorized transactions signed from your wallet
- Loss of access to your wallet due to lost credentials
- Any vulnerabilities in third-party marketplaces accessed through the Platform
You acknowledge that blockchain transactions are irreversible by nature. Once a transaction is confirmed on-chain, it cannot be reversed, cancelled, or refunded by anyone, including the Operator.
6. Marketplace Fees & Transactions
Crovia may charge a marketplace fee on transactions executed through the Crovia marketplace smart contracts. Aggregated purchases routed through third-party marketplaces are subject to those marketplaces' respective fee structures, over which we have no control. Creator royalties are enforced as set on-chain via ERC-2981 where applicable. You are responsible for understanding the total cost of any transaction, including gas fees, before confirming it.
7. Third-Party Content & Services
Crovia aggregates data from third-party sources and links to third-party marketplaces and services. We do not guarantee the accuracy, completeness, reliability, or timeliness of any third-party data, including but not limited to pricing, volume, listing information, NFT metadata, or images. The Platform may display information that is delayed, inaccurate, or outdated. Use all data at your own risk.
We are not responsible for the content, policies, security practices, or actions of any third-party marketplace, protocol, or service accessed through or linked from the Platform. Your interactions with third-party services are governed by their respective terms.
8. Intellectual Property
NFT artwork, metadata, and associated content are owned by their respective creators and rights holders. Crovia does not claim ownership of any NFT content displayed on the Platform. The Crovia name, brand, logo, and platform design are the property of the Operator. You may not reproduce, distribute, or create derivative works from the Platform without prior written consent.
9. Prohibited Activities
You agree not to:
- Use the Platform for money laundering, terrorist financing, or any illegal activity
- Manipulate markets through wash trading, spoofing, or other deceptive practices
- Attempt to exploit, hack, reverse engineer, or disrupt the Platform or its infrastructure
- Scrape, harvest, or collect data from the Platform for commercial purposes without permission
- Use the Platform in violation of any applicable laws or regulations, including Finnish law and EU regulations
- Impersonate any person or entity, or misrepresent your affiliation
- Upload or distribute malicious code, viruses, or harmful content
10. Assumption of Risk
By using the Platform, you expressly acknowledge and accept the following risks:
- Blockchain technology and smart contracts may contain bugs, vulnerabilities, or errors
- NFTs may lose all value or become illiquid
- Regulatory changes may affect the legality or value of digital assets
- Network congestion, forks, or outages may affect transactions
- Third-party marketplaces may change their APIs, terms, or cease operations without notice
- Digital assets may be subject to theft, fraud, or loss through no fault of the Operator
- Tax obligations related to NFT transactions are your sole responsibility
11. Limitation of Liability
To the maximum extent permitted by applicable law, including Finnish consumer protection law (kuluttajansuojalaki) and the Finnish Tort Liability Act (vahingonkorvauslaki):
- The Platform is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express, implied, or statutory, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
- The Operator shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Platform, including but not limited to loss of funds, loss of data, loss of profits, loss of digital assets, wallet compromise, or any damages resulting from unauthorized access to your wallet or accounts.
- The Operator's total aggregate liability, if any, shall not exceed the amount of fees you have paid directly to Crovia in the twelve (12) months preceding the claim.
- Nothing in these Terms excludes or limits liability that cannot be excluded or limited under mandatory Finnish law or EU consumer protection regulations.
12. Indemnification
You agree to indemnify, defend, and hold harmless the Operator, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; (d) any transaction you conduct through the Platform; or (e) your negligence or wilful misconduct.
13. Privacy & Data Processing
The Platform processes minimal personal data. Wallet addresses used on the Platform are pseudonymous blockchain identifiers. We do not collect names, email addresses, or other personally identifiable information unless voluntarily provided (e.g., via contact email). Any data processing is conducted in accordance with the EU General Data Protection Regulation (GDPR) and the Finnish Data Protection Act (tietosuojalaki). Blockchain transactions are publicly visible and immutable by nature.
14. Service Availability
We do not guarantee uninterrupted, error-free, or secure access to the Platform. The Service may be modified, suspended, or discontinued at any time without notice. We are not liable for any loss or damage resulting from service interruptions, whether planned or unplanned.
15. Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of Finland, without regard to conflict of law principles. Any disputes arising from or relating to these Terms or the use of the Platform shall be resolved in the courts of Finland. For consumers residing in the EU, mandatory consumer protection laws of your country of residence shall apply where they provide greater protection. EU consumers may also refer disputes to the Consumer Disputes Board of Finland (kuluttajariitalautakunta) or the European Commission's Online Dispute Resolution platform.
16. Modifications to Terms
We reserve the right to modify these Terms at any time. Material changes will be indicated by updating the "Last updated" date. Continued use of the Platform after modifications constitutes acceptance of the updated Terms. It is your responsibility to review these Terms periodically.
17. Severability
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.
